Army Veteran Sues VA in Medical Malpractice Case

An army veteran that underwent penis surgery in 2010 is suing the Veterans Affairs Hospital for negligent care during the surgery.

On October 28, 2010, 61-year-old Michael D. Nash entered the Lexington VA Medical Center for medical surgery on his penis, which included an implant and circumcision. After the surgery, a nurse applied an ice pack to Nash’s groin area in an effort to reduce swelling. However, according to Nash, the nurse failed to remove the ice pack for close to 19 hours, resulting in permanent damages.

Within a few weeks of the incident, gangrene formed on Nash’s penis, which resulted in another surgical procedure that required an incision to remove a five-inch area of skin. Nash stated that he is still receiving medical treatment stemming from the negligence.

According to Nash’s attorney, several other problems have arisen from the negligence of the VA medical staff:

“It basically caused frostbite on his penis, which eventually caused gangrene. In addition to robbing someone of their manhood, they’ve robbed him of the simple ability to urinate just like every other person who lives in this world.”

At first, Nash filed a lawsuit under the Federal Tort Act, but the Department of Veterans Affairs rejected his claim. As a result, he filed a suit this past Tuesday at the U.S. District of Louisville under medical malpractice.

Nash is seeking damages in the amount of $10 million from the medical government.
